Every five years, the Benchmark Survey of U.S. Direct Investment in Foreign Business Enterprises is conducted by the Bureau of Economic Analysis (BEA), an agency in the United States Department of Commerce.
In order to complete the survey, the BEA relies on BE-10 reports filed by U.S. reporters.
A U.S. reporter is defined as any U.S. person that owned, directly or indirectly, 10% or more of the voting stock of a foreign corporation, or an equivalent interest in an unincorporated foreign business enterprise (a partnership), at any time during the 2014 fiscal year.
The deadline for U.S. reporters with fewer than 50 forms to file is May 29, 2015. However, if the U.S. reporter must file 50 or more forms for its foreign affiliates, the deadline is June 30. The BEA has provided relief to any first-time U.S. reporter by extending the May due date to June 30, 2015.
Any U.S. reporter that fails to file a BE-10 report could incur a civil penalty between $2,500 and $25,000, and criminal sanctions may be incurred for willfully failing to file the BE-10 report.
