ERISA and Non-ERISA, Options for Owners

Unemployment remains at an all–time low! Which is great for our economy, but it also means employees hold all of the cards. Non-ERISA plans provide many benefits, but they come with some risks as well. We’ve broken down the key pros and cons to consider below:

Benefits:

  • No IRS limitations on contributions
  • Employer can choose who participates and who doesn’t
  • No DOL compliance testing required
  • No Vesting requirements
  • Employee is not taxed until distribution is taken

Compromises:

  • Tax deduction for Company comes later when employee takes distribution
  • Assets and liabilities are on the books of the employer and are not protected from creditors
